Terms of Use

These Terms of Use ("Terms", "Agreement") are a legal agreement between you and Nadzeya Yashchuk ("the Developer", "we", "us", "our") governing your use of the mobile game Tap me: Freedom for the arrows ("the App", "the Game").

By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions and Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA", apple.com/legal/internet-services/itunes/dev/stdeula), solely for your personal, non-commercial entertainment. To the extent these Terms conflict with the Apple Standard EULA, these Terms govern except where the Apple Standard EULA's minimum terms must prevail.

2. Restrictions

You agree not to:

  • copy, modify, or create derivative works of the App;
  • reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law;
  • rent, lease, lend, sell, redistribute, or sublicense the App;
  • remove or alter any proprietary notices;
  • use the App to violate any law or the rights of others, or to interfere with its normal operation (including cheating, exploiting, or manipulating ads or purchases).

3. Advertising

The App is free to download and is supported by third-party advertising served through Google AdMob, including banner-style, full-screen (interstitial), and optional rewarded ads. Rewarded ads are always optional and grant in-game benefits (such as an extra life) only if you choose to watch them. Advertising practices and your tracking choices are described in our Privacy Policy.

4. Subscriptions and auto-renewal

The App offers optional auto-renewable subscriptions that remove advertising ("Remove Ads"). The following terms are required and apply to all subscriptions:

  • Title and content. "Remove Ads" — disables in-app advertising for the duration of the subscription.
  • Subscription options and length:
    • 1 Month — billed monthly;
    • 6 Months — billed every six months;
    • 1 Year — billed yearly, and offered with a 3-day free trial for new subscribers.
  • Price. The price for each option is displayed in the App at the point of purchase. Prices are set per region by Apple and may vary; the price you see and confirm in the App applies.
  • Payment. Payment is charged to your Apple ID account upon confirmation of purchase.
  • Auto-renewal. A subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Renewal charge. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
  • Managing and canceling. You can manage or cancel your subscription, and turn off auto-renewal, in your App Store account settings after purchase (Settings → your name → Subscriptions).
  • Free trial. If you purchase a subscription that includes a free trial, any unused portion of the trial is forfeited when you purchase that subscription, to the extent applicable. The free trial is available to eligible new subscribers only, as determined by Apple.

All billing, refunds, and subscription management are handled by Apple under the Apple Media Services Terms and Conditions. Refund requests are subject to Apple's policies; we cannot directly issue refunds for App Store purchases.

5. Intellectual property

The App and all of its content, design, graphics, code, and trademarks are owned by the Developer or its licensors and are protected by intellectual-property laws. Except for the license granted in Section 1, no rights are transferred to you.

6. User conduct and eligibility

You must be old enough to form a binding contract and to use the App under the laws of your country (and at least the minimum age stated in our Privacy Policy). You are responsible for use of the App on your device and for compliance with these Terms.

7. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

8. Limitation of liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total aggregate liability for any claim relating to the App shall not exceed the greater of (a) the amount you paid for the App or subscriptions in the twelve months before the claim, or (b) USD 10. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App or violation of these Terms.

10. Termination

This license is effective until terminated. It terminates automatically if you breach these Terms. Upon termination you must stop using and delete the App. Sections that by their nature should survive (including Sections 5, 7, 8, 9, and 11) survive termination.

11. Apple-specific terms (Licensed Application End User License Agreement)

You and we acknowledge that these Terms are concluded between you and the Developer only, and not with Apple. The following terms apply pursuant to Apple's minimum EULA requirements:

  • Scope. Your license is limited to use on Apple-branded products you own or control, as set out in the Usage Rules of the Apple Media Services Terms.
  • Maintenance and support. The Developer, not Apple, is solely responsible for any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
  • Warranty. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims will be the Developer's sole responsibility.
  • Product claims. The Developer, not Apple, is responsible for addressing any claims relating to the App, including (i) product-liability claims; (ii) any claim that the App fails to conform to legal or regulatory requirements; and (iii) claims under consumer-protection, privacy, or similar legislation, including in connection with the App's use of advertising frameworks.
  • Intellectual property. In the event of any third-party claim that the App or your use of it infringes intellectual-property rights, the Developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints, or claims regarding the App should be directed to contact@nadzeyayashchuk.com.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data plan).

12. Governing law

These Terms are governed by the laws of Austria, without regard to its conflict-of-laws rules, except that mandatory consumer-protection laws of your country of residence continue to apply. The Apple Media Services Terms and Conditions also continue to apply to your use of the App as between you and Apple.

13. Changes to these Terms

We may modify these Terms from time to time. The "Last updated" date reflects the current version, and material changes will be reflected in the App or at the Terms URL. Continued use after changes take effect constitutes acceptance.
